By creating an account or using OddsOut ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the App.
These Terms form a legally binding agreement between you and Diogo Alexandre de Freitas Dias Ipolliti Carrelhas ("we", "us", "our"), based in Lisbon, Portugal.
OddsOut offers tools to support your recovery, including:
Features may evolve, be added, or be removed over time. We will give you reasonable notice before removing a feature you actively use.
New accounts receive a 30-day free trial of all premium features. You will not be charged during the trial. We will remind you before the trial ends.
After the free trial, your selected plan (monthly or annual) renews automatically at the then-current price unless cancelled at least 24 hours before the renewal date. Renewals are billed by Apple (App Store) or Google (Google Play) — not directly by us — and you can manage or cancel renewal at any time in your phone's subscription settings.
Current prices are displayed in the App before you subscribe and may differ by country and applicable taxes.
You can cancel any time through your phone's subscription settings:
After cancellation, you keep premium access until the end of the paid period. We do not pause or partially refund unused time.
Refund decisions are handled by Apple or Google according to their respective policies, not by us. To request a refund:
You agree not to:
We use automated content moderation to detect gambling promotion and harmful content. Posts that violate these rules may be blocked automatically. We may also suspend or terminate accounts that repeatedly violate these Terms.
When you post in the forum, reply to others, or send messages to a Battle Buddy, you are responsible for your content. By posting, you grant us a non-exclusive, worldwide, royalty-free licence to display that content within the App so other users can see it. You can delete your posts at any time. Deleting your account anonymises your past posts (your name and ID are replaced with "Former member") so the conversation context survives without identifying you.
We do not claim ownership of your content. The licence above is solely to make the community feature work.
The App, its design, code, content (excluding user-generated content), trademarks, and logo are owned by us. You receive a limited, personal, non-transferable, non-exclusive licence to use the App for its intended purpose. All other rights are reserved.
How we collect and use your data is described in our Privacy Policy, which is part of these Terms.
OddsOut is provided "as is" and "as available". We make reasonable efforts to keep the App running, accurate, and useful, but we do not guarantee that:
The App is not a substitute for professional medical, psychological, or financial advice. If you are experiencing a crisis or considering self-harm, please contact a qualified helpline or emergency services immediately.
To the fullest extent permitted by law, we are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of, or inability to use, the App. Our total cumulative liability to you in any twelve-month period is limited to the amount you paid us in subscription fees during that period.
Nothing in these Terms limits your statutory consumer rights under Portuguese or EU law, including rights you cannot waive by contract.
You may delete your account at any time through Settings → Delete Account. We may suspend or terminate your account if you materially violate these Terms, with notice unless the violation requires immediate action (e.g. severe abuse of the community).
We may update these Terms as the App evolves. Material changes will be notified through the App and by email at least 14 days in advance. Continued use after the effective date constitutes acceptance of the revised Terms.
These Terms are governed by the laws of Portugal. Any dispute arising from these Terms or your use of the App is subject to the exclusive jurisdiction of the Portuguese courts, without prejudice to any mandatory consumer protection rules of your country of residence within the European Union.
EU consumers may also use the European Commission's Online Dispute Resolution platform.
